Remove race based laws
Feb 27 2008, 12:29 AM EST
Our race based laws have caused more harm than good. People should receive government benefits or assitance because of their circumstances not their race. Our constitution and our legislation should be colour blind. Everybody should be equal before the law.

Could you provide some clarification - Are the people who have written the laws representative of peoples of this nation? What do you mean by everybody should be 'equal'? Why just attach 'equal' to 'law'?

it makes so much sense but the government is afraid to back such an idea because it may be called "racist", while people who are worse off should still receive adequate welfare it is not fair to give more to people because of their race.

"Everyone should be equal before the law" The laws have never treated Aboriginal people equally for the past 200 years that Non-Indigenous people have been here. If it was equal than the Prime Minister would never of had to say 'Sorry' to the countless number of people removed because of their race.

I think this is something that Australia should work towards but I am not sure if it is a practical option at the moment. While circumstances will describe many who require assistance, many aboriginal's have a cultural identity that is making it more difficult again to dig their way out of poverty. There are far fewer role models for aboriginals. Without race based laws, it will be tougher to focus services in particular areas where it is needed. Cheers, Dale 4 out of 6 found this valuable. For 200 years we have treated aborigines as different. The result for a lot of them has been quite dire. I suggest the time is right to treat aborigines the same as everybody else. This idea that we can help them if we keep the poison of a racist constitution and racist laws just a little longer is flawed. We should all be equal before the law.

Many of worse off aboriginals live in isolated communities. Laws to distinguish these groups would not need to be based on their race, it could just as easily be based on their isolation. ie small populations in isolated areas should be treated like.....I would still worry about practical issues. Is it even fair to not allow recognition of Aboriginal heritage if Aboriginals still suffer blatant racism. If they can't find a job because they are aboriginal ie employer racism, then might it not be practical to have specific policy aimed at overcoming this real world effect? To remove so-called 'race-based' laws would mean removing what little positive discrimination exists in favour of Aboriginal people. By all means try to remove whatever negative discrimination exists in the treatment of our indigenous population, but having dispossessed them of their land, their culture and their languages, and imposed upon them an alien culture with its correlates of alcohol, tobacco, disease and discrimination, I think they are owed some reparation. Saying "Sorry" is a good start but it must not be the end.

Positive discrimination has been quite poisonous. Aboriginies are people. They should have the same rights as other people. No more, no less. We don't need racist laws to look after the disadvantaged.

"Positive discrimination has been quite poisonous. Aboriginies are people. They should have the same rights as other people. No more, no less. We don't need racist laws to look after the disadvantaged. "Some forms of positive discrimination have been subject to the law of inintended consequences. The well-meant provision of welfare to unemployed Aborigines resulting in boredom leading to chronic alcoholism in some communities is one example. The answer is not to remove access to welfare but to address the situation that resulted in the need for welfare in the first place. This might still require positive discrimination but if well directed and well planned it could eventually create a situation where such discrimination is no longer necessary. 3 out of 5 found this valuable.
